USITC Confirms Countervailing Duties On Tubing From China, India

The United States International Trade Commission (USITC) will issue countervailing duty (CVD) orders on imports of cold-drawn mechanical tubing from China and India, after determining that they are causing material injury to US manufacturers.

On December 5, 2017, the Department of Commerce announced an affirmative final determination which calculated a final subsidy rate of 21.41 percent for mandatory respondent Jiangsu Hongyi Steel Pipe Co., and a final subsidy rate of 18.27 percent for mandatory respondent Zhangjiagang Huacheng Import & Export Co. Commerce determined a rate of 19.84 percent for all other Chinese producers and exports.

In the India CVD investigation, Commerce calculated a final subsidy rate of 8.02 percent for mandatory respondent Goodluck India and a finalsubsidy rate of 42.60 percent for mandatory respondent Tube Investments of India. Commerce determined a rate of 22.41 percent for all other Indian producers and exporters.

Following the Commerce investigation, USITC issued an affirmative determination on January 5, 2018, as a result of which Commerce will now issue CVD orders on imports of this product from China and India.

However, in contrast to the initial conclusion of the Commerce investigation, USITC made a negative finding concerning critical circumstances with regard to imports of the product from China. As a result, subsidized imports of cold-drawn mechanical tubing from China will not be subject to retroactive countervailing duties.

The petitioners were ArcelorMittal Tubular Products, Michigan Seamless Tube, PTC Alliance Corp, Webco Industries, and Zekelman Industries. The final report will be released by USITC on February 14, 2018.
