Turkish Media Giant Wins Further Tax Appeal

The Turkish media company, Dogan Yayin Holding AS (Dogan) has issued a statement claiming a further victory in its legal campaign to reverse tax demands totalling TRY4.8bn (USD3.2bn).

Group subsidiary, Doğan TV Holding, has obtained judgments in its favour totalling TLY1.05bn in respect of tax demands which it now no longer needs to pay.

The Turkish tax authorities claimed that Dogan had failed to pay VAT on mergers between its companies, something which Dogan, in the main, has disputed successfully. The group still await judgments from the Council of State on some of the claims and proceedings still continue.

In August 2010, Dogan reported that claims involving TLY865m in fines had been resolved in its favour, while the the tax administration would benefit with TLY1.88m in its favour. Dogan has succeeded in overturning tax demands in the past, including a claim for TLY772.5m last February in respect of the sale of a stake in a Dogan subsidiary to Axel Springer.

The chairman, Aydin Dogan, had accused the Turkish government of levying excessive tax fines on his news conglomerate to silence the network after several stories alleging widespread corruption within the government were published. Dogan owns seven newspapers, 28 magazines and three Turkish television channels with a market share estimated at about 30%.
