Transitional Rules Released For EU's New Customs Code

On December 17, 2015, the European Commission adopted a delegated act to establish transitional rules for operators and customs authorities, ahead of the introduction of new IT systems to create a fully electronic customs environment in the European Union.

The rules, which will be operational for a limited period, have been issued to ensure that companies are prepared for the new Union Customs Code (UCC). The rules are intended to ensure a smooth transition between existing and new customs rules, while IT infrastructure continues to be developed. The complete deployment of all of the electronic systems required by the UCC will be complete on or before December 31, 2020

Adopted on 2013, the UCC's substantive provisions will be operational from May 1, 2016. According to the Commission, the UCC and the related delegated and implementing acts will:

  • Streamline customs legislation and procedures;
  • Offer greater legal certainty and uniformity to businesses;
  • Increase clarity for customs officials throughout the EU;
  • Simplify customs rules and procedures and facilitate more efficient customs transactions in line with modern-day needs;
  • Complete the shift by Customs to a paperless and fully electronic environment; and
  • Reinforce swifter customs procedures for compliant and trustworthy economic operators (Authorised Economic Operators).
