Taiwan, India In New USB Flash Drive Tax Spat

by Mary Swire, Tax-News.com, Hong Kong

Taiwan has requested consultations with India regarding its anti-dumping duties on USB flash drives.

India began imposing an anti-dumping duty on USB flash drives manufactured by Taiwanese companies at a rate of USD3.06 per unit on May 22 of this year, according to Taiwan's Ministry of Economic Affairs.

Taiwan alleges that the anti-dumping duty violates World Trade Organization (WTO) rules and has had a negative impact on Taiwan's exports of USB flash drives.

The request for consultations formally initiates a dispute in the WTO. Consultations give the parties an opportunity to discuss the matter and to find a satisfactory solution without proceeding further with litigation. After 60 days, if consultations have failed to resolve the dispute, the complainant may request adjudication by a panel.

Over the past three years, India has been the eighth-largest importer of Taiwanese USB flash drives. Taiwan's exports of USB flash drives to India averaged USD206m per year in the period.
