Taiwan, Germany DTA Enters Into Force

Taiwan's Ministry of Foreign Affairs has announced that the double taxation agreement (DTA) between Taiwan and Germany entered into force on November 7, 2012, after ratification procedures were completed in both countries.

The provisions of the DTA, which was signed in Berlin on December 19, 2011, and then also in Taipei on December 28, will apply from January 1, 2013.

The agreement covers, amongst other things, the avoidance of double taxation of dividends and capital gains, whilst also including provision for tax information exchange.

According to the Ministry, it is hoped that the agreement will create a favorable environment to encourage trade and investment between the two countries, and will expand bilateral trade and employment opportunities.

Germany is Taiwan's largest trading partner in the European Union, with total trade between the two countries having grown in 2011 by 10.3% to USD16.2bn, in spite of the European debt crisis. In addition, there are already more than 200 Taiwanese businesses present in Germany, while more than 250 German enterprises have invested a total of USD1.9bn in Taiwan.
