Switzerland Fines Airlines For Freight Charge Fixing

by Ulrika Lomas, Tax-News.com, Brussels

14 January 2014

The Swiss Competition Commission (COMCO) has slapped fines worth CHF11m on a dozen airlines for manipulating prices in the Swiss air freight market.

COMCO found that, between 2000 and 2005, several airlines had agreed on freight rates, fuel surcharges, war risk surcharges, customs clearance surcharges for the United States, and the commissioning of surcharges. A total of twelve airline groups have been sanctioned; another airline triggered the legal proceedings by self-denunciation, and therefore benefited from complete immunity.

The Swiss Government stated: "Horizontal price agreements of this type are serious infringements of Article 5 Paragraph 3 of the Cartel Act. Besides the COMCO, the EU-Commission and the US Department of Justice, among others, inquired into and sanctioned the behavior of various airlines."
