Switzerland Eyes New Gambling Tax Legislation

The Swiss Federal Administration has recently unveiled details of the Federal Council’s plans for a new gambling law, including plans to introduce a new regime for the taxation of betting gains.

In its release, the Federal Administration highlights the fact that gains from lotteries and from professional wagers are currently subject to taxation in the Confederation, while gains realized in a casino are exempt from taxation.

Consequently, to end this "inequality" as regards tax treatment, the Federal Council intends to exempt all winnings from tax, the Administration explains.

The resulting shortfall of fiscal revenues for the Confederation and for the Swiss cantons should be offset at least in part by additional revenues, given that the new legislation will serve to make gambling more attractive in Switzerland in the future, the Federal Administration emphasizes.

Switzerland’s proposed new gambling law is designed to protect against gambling addiction, ensuring that operators put in place appropriate measures aimed at mitigating the risks of pathological gambling. The emphasis is on prevention.

The Federal Council also intends to end the absolute ban on online casinos, to ensure that revenues from these games are kept in Switzerland rather than flowing to foreign operators. These revenues can then be used to fund cultural, sporting and social projects, for example.

The Federal Council aims to launch the consultation on its new gambling law in the second half of 2013.
