Switzerland Abolishes Tax Rebate Committee

Following a recent sitting, the Swiss Federal Council announced plans to abolish the Federal Committee (CFR) responsible for federal direct tax rebates. The Federal Council is introducing new provisions for federal direct tax rebates.

As part of efforts to simplify the tax system, by eliminating certain duplications that occur between the Confederation and the cantons in Switzerland, all requests for federal direct tax rebates are to be examined by the cantons in future. The cantons will designate the competent cantonal authority responsible for the task.

In Switzerland, taxpayers that are experiencing financial difficulties may request a tax remission. Under current law, the CFR is responsible for ruling on applications for federal direct tax rebates in excess of CHF25,000 (USD34,489) a year, while requests for federal direct tax rebates of less than CHF25,000 a year, together with those pertaining to cantonal and communal tax, are dealt with by the cantons. Last year, the CFR issued a ruling on 56 applications for federal direct tax remissions, amounting to a total sum of around CHF4.9m.

Furthermore, the Federal Court will ultimately decide in future on appeals relating to "particularly important" cases. Therefore, for basic legal issues, unity of jurisprudence will be guaranteed throughout Switzerland.
