Swiss Bill Permits Online Gambling, Modifies Taxes

The Swiss Federal Council has launched a consultation on a proposed gambling law, which newly allows online gambling, exempts all winnings from taxation, and maintains the tax on casino operators.

Under current legislation, winnings from lottery games and from betting are subject to taxation in Switzerland, while casino winnings are exempt. The Federal Council wants to end the unequal tax treatment of gambling gains, and to align the nation's tax regulations with rules applied in other countries.

Meanwhile, the new law retains the requirement for casinos to obtain permission to operate from the Confederation. It also preserves the existing tax imposed on casinos, with the product of the levy flowing to the nation's social security and pension fund (AHV) at federal level, and to support cultural, social, and sporting projects at cantonal level.

Finally, the draft legislation strengthens measures aimed at preventing gambling addiction, money laundering, and game fixing. It will replace the existing casino law dating from December 18, 1998, as well as the federal law on lotteries and betting dating from June 8, 1923. The consultation ends on August 20.
