Second LuxLeaks Whistleblower To Fight Conviction

by Ulrika Lomas, Tax-News.com, Brussels

18 April 2017

A second whistleblower involved in the "LuxLeaks" affair has announced that he intends to continue appealing against his criminal conviction.

Raphael Halet confirmed that he would seek to continue fighting the case, in a communique published on April 12.

Halet said that by continuing with the legal action, he hoped to score a victory for tax transparency and if necessary would take the fight to the European Court of Human Rights.

Last year, Halet and fellow whistleblower Antoine Deltour were given suspended jail sentences by a Luxembourg court for their role in passing to the media thousands of documents detailing private tax rulings between multinational companies and the Luxembourg tax authority. Both men were also ordered to pay fines of EUR1,500 (USD1,600) and EUR1,000, respectively.

On March 15, 2017, a Luxembourg appeal court halved Deltour's suspended sentence to six months, while Halet's suspended sentence was lifted. However, the appeal court ruled that the criminal convictions against the two men should stand and ordered them to pay their respective fines.

Halet's revelation followed an announcement by Deltour earlier this month that he intends to continue the legal campaign to clear his name.
