Obama Signs Temporary US Internet Tax Moratorium

On September 30, President Barack Obama signed into law the "Continuing Appropriations Act, 2016" that, while providing funding for the US Federal Government until December 11, 2015, also extends the Internet Tax Freedom Act (ITFA) until the same date.

First enacted in 1998, ITFA blocks state and local governments from imposing new taxes on internet access, or to impose multiple or discriminatory taxes on e-commerce. ITFA has been extended multiple times and was scheduled to expire on October 1, 2015.

The further temporary extension is intended to allow Congress more time to consider whether to approve a permanent ITFA extension, as was passed already by the House of Representatives in June this year.

Previous attempts to pass similar legislation in the Senate have been complicated by attempts to tie it to the more contentious Marketplace Fairness Act, which would allow US states to impose sales taxes on internet purchases made from online retailers outside their borders.

CompTIA, the Computing Technology Industry Association, applauded the House and Senate for the passage of the bill. However, "we continue to urge Congress to pass a permanent extension that will avoid future uncertainty for both internet service providers and internet users," said Elizabeth Hyman, its Executive Vice President, Public Advocacy.
