No Date Yet For Apple To Pay Irish State Aid Bill

by Jason Gorringe, Tax-News.com, London

The Irish Government does not yet have an exact date on which Apple will begin paying the EUR13bn (USD15.3bn) in back taxes the European Commission alleges the company owes.

Earlier this week, Irish Finance Minister Paschal Donohoe confirmed that the Government had reached an agreement with Apple on the "principles and operation" of the escrow fund into which the money will be placed while the Government's appeal against the Commission's ruling is heard by the European Court of Justice.

However, Donohoe has now told state broadcaster RTE that the Government has yet to conclude with Apple "when it will move in and how it will move in."

Donohoe added that he expects the "process to begin when we have completed the setting up of the escrow account." Donohoe hopes that the tender process for the management of the escrow account to be completed by January. The tender process has been ongoing since July.

In September 2016, a European Commission investigation concluded that two rulings provided by the Irish Government had "substantially and artificially lowered the tax paid by Apple in Ireland since 1991." It estimates the amount of illegal aid to be recovered by the Irish authorities to be around EUR13bn.

In October, the Commission referred Ireland to the EU Court of Justice for its failure to collect the money.
