Italy's Patent Box Sees High Number Of Applications

By end-December 2015, the number of Italian businesses that had applied to take advantage of Italy's "patent box" in its first operational fiscal year had reached a greater-than-expected 4,500.

As expected, the northern regions of Italy saw the largest number of applications. Requests from Lombardy reached 1,240, followed by Veneto at 706, and Emilia Romagna at 636.

It had not been foreseen, however, that applications would be received from a wide range of businesses, both large and small. More than 650 firms with a turnover of less than EUR1m (USD1.1m), particularly startups, chose to apply for the optional tax regime, and the greatest number of requests (1,349) was received from companies with a turnover between EUR10m and EUR50m.

The patent box offers an optional preferential tax regime for income derived from the use or licensing of qualifying intangible assets (such as patents, trademarks, processes, and other intellectual property) that are linked to research and development activities carried out in Italy.

Businesses will be able to exclude up to 50 percent of their income derived from such assets from income taxes (either corporate or individual) and the regional tax on production. The five-year income exclusion will amount to 30 percent in the first year of its operation, 40 percent in the second year, and reach 50 percent from the third year.
