Italy To Extend Reverse Charge VAT To Tablets, Laptops

At a Cabinet meeting on November 6, the Italian Government approved a draft decree that will apply the reverse charge value-added tax (VAT) mechanism to sales of laptops, tablet PCs, and gaming consoles on a temporary basis for two years until December 31, 2018.

The decree would activate in Italy the provisions of the European Union Directive 2013/42/EU and 2013/43/EU, which established a "quick reaction mechanism" (QRM) against VAT fraud by means of the optional and temporary application of reverse charges. The reverse charge shifts the obligation to account for VAT to the recipient, instead of the supplier.

The temporary QRM option provided by Directive 2013/42/EU is subject to notification to the European Commission (EC). In order to ensure the exercising of the option is proportionate to the problem, the EC has one month in which to appraise the notification and confirm whether it objects to the QRM special measure.

Directive 2013/43/EU issued an updated list of goods and services to which the reverse charge mechanism could apply. Supplies of tablet PCs, laptops, and game consoles were then added to the list.
