IoM Registry Preparing Maritime Law Amendments

The Isle of Man Shipping Registry launched two consultation papers during November, on the draft Merchant Shipping (MARPOL Annex IV: Prevention of Pollution by Sewage) Order 2014 and accompanying draft Manx Shipping Notice (MSN041,) to give effect to the latest amendments to MARPOL Annex IV, and on amendments to respond to an international review of the Standards of Training, Certification and Watchkeeping (STCW) Convention.

It is proposed that the two amendments, to modernize the legislative regime governing Manx-registered vessels, will take effect from April 1, 2014, and from March 2014, respectively.

The first consultation, on MARPOL Annex IV amendments, affects :

  • Manx ships of 400 gross tonnage or more;
  • Manx ships of less than 400 gross tonnage that are certified to carry more than 15 people; and,
  • Any fixed or floating platform that is engaged in the exploration and exploitation of the sea-bed and sub-oil within Manx territorial waters.

Part 5 of the Order will apply MARPOL Annex IV to a foreign ship in a Manx port or offshore terminal.

The second consultation amends Manx provisions concerning the STCW Convention, establishing basic requirements on training, certification and watchkeeping for seafarers on an international level. A comprehensive review of these requirements, known as the Manila Amendments, bolster conditions for seafarers, namely pertaining to: training and certification, hours of work and rest, prevention of drug and alcohol abuse, and medical fitness standards for seafarers. The consultation paper sets out the Isle of Man Government's proposal to implement new Regulations in order to give effect to the STCW Convention up to and including the Manila Amendments.
