Indian Cabinet Approves Amendments To Trademarks Bill

It was announced on Thursday that the Indian Cabinet has approved modifications to the Trade Marks (Amendment) Bill, 2007.

The changes were made on the basis of recommendations contained in the Report of the Department Related Parliamentary Standing Committee on Commerce.

The Trade Marks (Amendment) Bill 2007 was initially approved by the Cabinet on February 8, 2007, and was introduced to the Lok Sabha (or lower house) on August 23 of that year. The Bill was then referred to the Department Related Parliamentary Standing Committee on Commerce in October 2007, with the Committee presenting its report to both Houses of Parliament in March 2008.

The amended Bill is designed to provide better protection to Indian trade marks in designated member countries, and to afford reciprocal protection to trade marks from member countries.

It is hoped by the government that the new legislation will thereby "encourage transfer of technology through trade mark licensing and franchising and generally promote overall business confidence in the Indian intellectual property rights system globally".
