Indian Authorities To Collaborate On Tackling GST Refund Fraud

Local authorities in India have been instructed to draw up lists of taxpayers that have filed fraudulent or potentially fraudulent requests for input tax credits and where appropriate share this information with other state authorities.

In an instruction to local tax authorities dated January 13, 2020, the Directorate General of GST Intelligence announced the new requirement to report fake invoices or instances where an input tax credit had been sought in respect of goods and services not actually provided, to support Central GST officers to deny fraudulent GST refund requests.

The development follows an agreement among senior tax officials in India to tackle fraud immediately, at the 2nd National GST Conference of the Commissioners of State Tax and Chief Commissioners of Central Tax, held on January 7, 2020.

At this meeting, they agreed to undertake joint efforts to tackle GST refund fraud, including by introducing new measures by the end of January 2020. Indian authorities will probe more instances of refund fraud, and government agencies will improve how often they exchange information, they agreed. They also agreed new GST information disclosure requirements in the case of closure of a business.
