India Creates Additional Tax Tribunal Benches

The Indian Cabinet has given the go-head for the creation of six additional benches of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT).

The Government says that the new benches will make it quicker and easier to deal with cases, and reduce costs and travel time. Three will be set up at existing locations in New Delhi, Mumbai, and Chennai, with the remainder established in Chandigarh, Allahabad, and Hyderabad. There are at present ten benches, while CESTAT's headquarters and Principal Bench are located in Delhi.

Twelve new Members of the Tribunal will be appointed – six as Technical and six as Judicial Members – and a further 98 supporting posts will be established. The initial start-up cost to the Union Government is estimated at INR34.5m (USD565,714), while the recurring expenditure will stand at INR1bn a year.

CESTAT was established in 1982, with the aim of providing an independent and impartial forum in which appeals could made against orders and decisions passed by the Commissioners of Customs and Excise. Service Tax Appeals have been included in the Tribunal's jurisdiction since 1994, and it can hear appeals made in relation to the application of anti-dumping rules.
