HMRC In Accelerated Payment Notice Update

by Robert Lee, Tax-News.com, London

17 December 2014

HM Revenue and Customs (HMRC) has used its new Accelerated Payments powers to recover GBP32m (USD50.3m) in disputed tax since August.

HMRC began sending Accelerated Payment notices (APNs) to UK users of certain tax avoidance schemes in late August. The notices gave recipients 90 days to pay the tax in question. Around 30 scheme users were contacted in August. HMRC says that more than 99 percent of the disputed tax was paid within the deadline and several payment arrangements are also now in place.

APNs may be received by taxpayers that use a tax avoidance scheme disclosed by the promoter under the UK's disclosure of tax avoidance schemes (DOTAS) rules. Disclosed schemes are assigned a scheme reference number (SRN), which can be used by the taxpayer to check an online list of schemes, which is published by HMRC, to see whether they could be potentially liable to pay tax upfront while the scheme they have signed up to is challenged by HMRC.

Jennie Granger, HMRC's Director General for Enforcement and Compliance, said: "These results show HMRC is making good progress in tackling marketed tax avoidance. If anyone is concerned about being able to pay an Accelerated Payment notice, they should contact us as soon as possible to discuss their options."
