Germany To Launch Special Anti-Tax Fraud Unit

On November 18, 2019, the German Ministry of Finance published a question and answer section on its website to clarify the role of a new special unit within the tax authority designed to detect cases of tax fraud more quickly.

According to the FAQs, the special unit is being launched by the Government in response to the so-called cum-ex tax affair, which resulted in the loss of billions of euros in tax revenue due to traders claiming multiple tax refunds on the same security. Therefore, the unit will focus on detecting and shutting down large scale tax avoidance and evasion schemes, particularly in the capital markets, earlier than the tax authorities are able to do at present.

The unit will consist of 43 new posts within the Federal Central Tax Office, and five new posts within the Ministry of Finance. It will liaise with tax offices at state level, and will be established "as soon as possible," the Finance Ministry said.

Initially, the special unit will be tasked with reviewing existing cum-ex cases to relieve the burden placed on the tax and judicial authorities by the scale of the scandal. However, it is intended that the unit will be the central point of contact for all state and federal authorities when potential tax planning schemes are encountered in the capital markets.
