The European Court of Justice has been asked to hear a challenge against the Portuguese road tax, in Case C-640/17 –  Luis Manuel dos Santos v Fazenda Publica.

The applicant, Luís Manuel dos Santos, is asking the court to determine whether Portugal should be precluded from determining road tax liability with reference to the date of first registration in Portugal in situations where a vehicle was first registered earlier in another member state where doing so results in a higher tax liability.
