Canada Launches Resin Dumping Inquiry

The Canadian International Trade Tribunal has initiated a preliminary injury inquiry into the alleged dumping and subsidizing of plastics from China, India, Oman, and Pakistan.

A Montreal-based company, Compagnie Selenis Canada, has alleged that it has suffered injury as a result of the dumping and subsidizing of polyethylene terephthalate (PET) resin from these countries. PET is widely used for packaging and bottling products.

The Tribunal inquiry is being conducted as a result of a dumping and subsidizing investigation by the Canada Border Services Agency (CBSA).

The Tribunal will now consider whether there is a reasonable indication that the alleged dumping and subsidizing have caused injury. It will announce the results of this initial inquiry on October 17.

If the Tribunal concludes that there is reasonable evidence, the CBSA will continue its investigation. The CBSA will issue a preliminary determination by November 16.

Should the CBSA likewise find indications of dumping and subsidizing, it will continue with its investigations and, concurrently, the Tribunal will launch a final injury inquiry.

If the Tribunal finds that dumped or subsidizing products are injuring or threatening to injure the Canadian producers concerned, anti-dumping and/or countervailing duties will be imposed.

The Tribunal is an independent quasi-judicial body.
