Bulgaria Restores Access To E-Portal For VAT Refunds

On September 17, 2019, the Bulgarian National Revenue Agency (NRA) announced that the electronic value-added tax refund system for traders established in other European Union member states has been restored following a recent data breach.

The VAT refund portal was taken offline after NRA's database was accessed by hackers earlier this year, exposing confidential information on millions of taxpayers, including foreign vendors.

The NRA said that it will notify the revenue administrations of all member states for the period during which the service could not be used to prompt them to submit VAT refund claims.

The NRA also reminded taxpayers that the deadline for submitting VAT refund claims from other EU member states for tax for which the right to a refund has arisen in 2018 is September 30, 2019.

The agency said that the functionality of the service is unchanged. However, it warned taxpayers of possible delays to refunds due to anticipated high demand of the service at certain times.

Under the EU VAT Directive, most businesses who incur VAT in connection with their activities in an EU country where they do not habitually supply goods and services (and so are not required to register for VAT) are nevertheless entitled to deduct that VAT. This "deduction" is made by means of a refund from the EU country where they paid the VAT.

To avoid potential language problems, claimants send an electronic refund claim to their own national tax authorities, who then forward it to the EU country where the claimant incurred the VAT. Claimants are paid interest if the tax authorities in the EU country where they incurred the VAT are late in making the refund.
