Brazil Improving MAP Framework

Brazil has concluded a consultation on proposals to improve the current mutual agreement procedure framework included in its double tax agreements.

The consultation, which concluded on September 2, had noted that Brazil's current MAP framework is not "disciplined." It proposed to increase transparency in the MAP process, to ensure that Brazilian companies and individuals are able to fully claim the benefits of tax treaties.

The consultation document states that Brazil, as one of the Group of Twenty nations participating in the base erosion and profit shifting project, has committed to implementing the minimum standards on dispute resolution mechanisms put forward under Action 14 of the project. The minimum standards will ensure that treaty obligations related to the mutual agreement procedure are fully implemented in good faith and that administrative processes promote the prevention and timely resolution of treaty-related disputes.
