Yahoo Facing Countersuit Over IM Patent Infringement

by Glen Shapiro, LawAndTax-News.com, New York

15 March 2005

Internet portal, Yahoo is facing a countersuit brought against it by online gaming firm, Xfire over instant messaging patents.

Yahoo had brought legal action against Xfire, arguing that its in-game online messenger service was developed using patented technology owned by Yahoo, created following the defection of the technology's co-inventor, Chris Kirmse from Yahoo to Xfire.

However, in a response to Yahoo's allegations, the gaming firm called on the San Francisco federal court to dismiss the case.

It alleged that Yahoo's initial legal action was filed with the intention of driving it out of business, or forcing an unfair settlement, and went on to reveal that Yahoo had failed to take the preliminary step of sending a "cease and desist" letter before launching its lawsuit.

Xfire is reportedly seeking unspecified damages in compensation for the alleged unfair business practices employed by Yahoo.
