Verizon Accuses Vonage Of Infringing VoIP Patents

by Glen Shapiro, LawAndTax-News.com, New York

21 June 2006

It has emerged that Vonage is being sued by Verizon, which claims that several of its patents relating to Voice over Internet Protocol (VoIP) technology are being infringed.

The lawsuit, filed last week in a Virginia district court, alleges that through its internet telephony services, Vonage has infringed on patents covering areas such as interfaces between different types of network, call forwarding, voicemail, billing, detection of fraud, and wireless handset use.

"Vonage is aggressively marketing and advertising services made with Verizon's appropriated intellectual property," Verizon argued in its complaint.

However, Vonage has hit back, stating that:

"As a leading developer of VoIP technology, Vonage respects the valid intellectual property rights of others. Vonage believes that its services have been developed with its own proprietary technology and technology licensed from third parties and intends to vigorously defend the lawsuit."

"Vonage has not previously been notified by Verizon regarding the seven patents identified in the lawsuit and has engaged its outside intellectual property counsel to investigate the matter."

June is proving to be something of a trying month for the broadband telephone service provider, as it emerged earlier in the month that a class action lawsuit had been filed on behalf of those who invested in Vonage's $531 million initial public offering on May 24.

The complaint, filed by US law firm, Motley Rice LLC, alleged that the company and certain named officers and underwriters violated the federal securities laws by publishing a materially false and misleading joint Registration Statement and Proxy-Prospectus.
