It emerged last week that one of the largest spam originators in the United States has been forced to seek Chapter 11 protection by the country's tougher anti-spam rules.
Although Scott Richter, the owner of OptInRealBig.com settled with New York Attorney General Eliot Spitzer last summer, a court battle with Microsoft is still ongoing, and the software giant is reported to be seeking $46 million in compensation.
The firm, which describes itself as a "premier internet marketing company", stands accused of sending billions of unsolicited commercial e-mails via compromised IP addresses in 35 countries.
In its Chapter 11 filing, OptInReal Big announced that the protections were necessary as it could not cope with the legal assaults "by a number of companies across the country, including Microsoft, and still run a viable business".
