by Glen Shapiro, LawAndTax-News.com, New York

26 August 2004

The recently released National Association of Securities Dealers (NASD) annual report has revealed that the US Department of Justice is in the process of investigating a potential antitrust violation which took place between the American Stock Exchange (Amex) and the Chicago Board Options Exchange (CBOE).

Both of the organisations in the question deal in options contracts on equities, and the report announced that the DoJ was probing an alleged "product allocation agreement" between them. However, no further detail was given, and neither of the parties involved would comment on the matter beyond revealing that they were cooperating with the investigation, according to the Associated Press.

The NASD is in the process of selling Amex to its members, and is awaiting approval of the deal by the Securities and Exchange Commission.
