UK Law Society Threatened With Legal Action Over Delayed Reforms

The Office of Fair Trading (OFT) this week threatened to take legal action against the Law Society if it does not press ahead with reforms designed to liberalise the rules on the provision of legal services, known informally as the 'Tesco law' reforms.

The OFT reportedly revealed that it is investigating a complaint "from a major estate agency chain" which has argued that the Law Society's ban on solicitors sharing fees with professionals outside the sector, and on paying referral fees to non-solicitors, breaches UK competition law.

The Law Society, which met yesterday, has repeatedly moved to restrict changes to the rules on the provision of legal services in the past.

However, speaking this week, Law Society chief executive, Janet Paraskeva announced that:

"We are well aware that the OFT considers the present rules to be anti-competitive. The council will have the OFT's letter before them when they consider the paper on referral fees this week." She added that:

"We have been working with the government to see how best to advise the profession to meet the challenges of competition."
