Switzerland: Government Debates Making E-Signatures Valid

As e-commerce is rapidly becoming the "new economy", most governments have realised the value of creating legislation which will enable e-commerce businesses to thrive and Switzerland is one of the latest countries to take steps towards building e-commerce within its borders.

The Swiss government has given the go-ahead for consultations to take place on new legislation which will award electronic signatures the same legal status as those written by hand.

The consultations are expected to last two months and are viewed as the first step towards the introduction of a new digital signature law. If implemented the law will ensure that contractual agreements in electronic format will no longer require handwritten signatures to be added, which is currently the procedure. Instead, computer-generated signatures will be legally recognised and the law will provide for checks to be carried out on the documents to ensure that they are not altered once the electronic signatures have been added.

The justice ministry believes that, if introduced, the new legislation will enable e-commerce in Switzerland to thrive and strengthen the country's position in international e-commerce.
