Sweden Sees First File Sharing Conviction

by Ulrika Lomas, for LawAndTax-News.com, Brussels

27 October 2005

Ruling on Tuesday, the Vastmanland District Court handed down Sweden's first ever conviction for online file sharing, a move which has been welcomed by anti-piracy groups which viewed the country as a haven for such activity.

The Court found Andreas Bawer guilty of violating national copyright laws by making a film available for others to download, and fined him 16,000 kroner (US$2,000).

Although the verdict has been dubbed "a very big step forward" by the country's anti-piracy agency, Antipiratbyran, it has also been criticised as not taking a strong enough stance, with some observers suggesting that by failing to impose a custodial sentence, the Court may be encouraging file sharers to continue with their illegal activities.
