Scottish Law Society Ditches Recommended Fees

It emerged recently that in an effort to boost competition in the Scottish legal services sector, the Law Society of Scotland has withdrawn its tariff of recommended legal fees.

The Law Society took legal advice on the matter of recommended hourly fees following the publication of a report last year from then Competition Commissioner Mario Monti, entitled 'Competition in Professional Services'.

The Society was advised to withdraw its recommended Table of Fees but was told that it should still carry out its annual Cost of Time Survey of legal firms.

Duncan Murray, President of the Society explained recently that:

"The Society, as a responsible professional regulator, is acting to comply with European and national law as it develops. The Society has also decided to consult with the Scottish Executive, the OFT and the Lord President for their views on how this significant change should be effected and its impact on Auditors of Court who assess solicitors' fees."

Legal Aid fees, which are fixed by the Scottish Executive and confirmed by the Scottish Parliament, have not been affected by the changes.
