Microsoft Facing Legal Action Over 'Rogue Distributor' Comments

Software distributor, ITAC (UK) has launched a libel action against Microsoft in the High Court over allegations made by the software giant in the context of a parallel importing dispute.

Microsoft recently filed a civil case against ITAC, claiming that the firm had been importing software from an unauthorised distributor in the Middle East.

In addition to its lawsuit, the firm reportedly accused ITAC of doing business with a "rogue distributor" on its web site, and circulated the accusation via a media alert e-mail.

Although the UK reseller acknowledged in a statement that the dispute with Microsoft concerns the issue of alleged copyright and trademark infringement, it argued that the allegation made in the media went "way beyond" the issues set to be contested in court.

Speaking to Microscope magazine, William Lister, a partner in Manchester law firm Pannone & Partners, which is acting on behalf of ITAC (UK), observed that:

"It is quite clear from Microsoft’s publicity machine that it is seeking to litigate the disputed issues in the public arena rather than in a Court of Law, which is the proper forum for such a dispute."
