It emerged this week that Microsoft has launched its appeal with the Court of First Instance over requirements made by the European Commission that it provide its rivals with access to certain sections of its code.
As part of its antitrust ruling against the software giant, the EC in 2004 ordered Microsoft to disclose to its competitors the interfaces necessary for their products to work effectively in conjunction with its own software.
However, arguing that this could result in its intellectual property rights being abused if open source advocates which receive the information are permitted to publish it under open source licences, Microsoft has asked the CFI to prevent such a state of affairs from occurring.
"We are taking this step so that the court can begin its review of this issue given its far-reaching implications for the protection of our intellectual property rights around the world," Microsoft announced.
