The UK's Law Society is reeling following the announcement on Friday that Legal Services Ombudsman, Zahida Manzoor has been appointed to the newly created role of Legal Services Complaints Commissioner (LSCC), and will have the power to impose heavy fines on the Society if it misses its complaints' handling targets.
This transfer of part of the Law Society's regulatory brief to an external power has come as a blow to the regulator and industry body, which announced in a statement that:
"We are disappointed with the Lord Chancellor's decision...Our complaints' handling had improved significantly over recent years. However, we will work constructively with the Commissioner when she is appointed."
Speaking at the Law Society's annual conference with regard to the Commissioner's powers to issue fines, Lord Chancellor, Lord Falconer explained that:
"The fine has got to be sufficient to have an effect on a professional body. It has certainly got to be an effective stick." He went on to add that:
"It is a very significant step as far as the Law Society is concerned. It is a significant step because it brings in an external body that they have both got to co-operate with and comply with directions from."
