Jersey Releases Draft E-Coms Legislation for Comment

Jersey has released its draft electronic communications legislation for consultation. The legislation aims to further increase confidence in Jersey's rapidly expanding e-business industry and the technology framework that underlies the industry.

The draft law covers aspects of electronic communications, the legal recognition of electronic signatures and electronic records, and removes obstacles in other legislation to the use of electronic communication and storage in place of paper methods. There is also an approvals scheme for businesses and other organisations providing cryptography services, such as electronic signature services and confidentiality services.

Commenting on the draft, Jersey States IS/IT Strategy Adviser Peter Griffiths, said: "The States have given the highest priority to the enactment of electronic communications legislation and the law draftsmen have made stringent efforts to produce this consultation document before Christmas. Indeed, at the inaugural British - Irish Council Summit only last week Senator Pierre Horsfall made a commitment that the Island shall, "…Have a comprehensive e-commerce Law in place within the next three months, coupled with an Island-wide information technology strategy supported by significant public investment…".

"It is encouraging that the Island is so committed to developing another pillar of the economy. The new legislation will reinforce Jersey's position as a leading international finance centre and as an attractive jurisdiction for e-business. It will also demonstrate the Island's innovation and commitment to industry growth within a stable and sustainable legislative environment" Mr Griffiths said.

The draft legislation can be viewed on Jersey Information Society Commission web-site (www.jerseyisc.org) and the closing date for comments is Friday 21 January 2000.
