Italian File Sharers Face Jail Under New Law

by Ulrika Lomas, for LawAndTax-News.com, Brussels

24 May 2004

taly's parliament on Wednesday voted to approve harsh penalties for those who use peer-to-peer (P2P) file sharing networks, despite opposition to the proposals from the Communist and Green Parties.

Under the newly approved legislation, the provision in Italian copyright law reserving the most severe punishments for those who infringe copyright for financial gain has been removed.

Those found guilty of copyright violation under the new laws, whether performing such an act for financial gain or not, face a fine of between EUR154 and EUR1032, a jail sentence of between six months and three years, and the publication of their details in the Italian national press.

According to reports, however, the opposition parties have gained permission from the Senate for a re-examination of the penalties imposed on violators.
