Injunction Upheld In 'Whois' Marketing Case

The US Court of Appeals for the Second Circuit in New York on Wednesday upheld an injunction against web-hosting company, Verio Inc. which prohibits it from making use of Register.com's 'Whois' database for marketing purposes.

The domain name registrar sued Verio in 2000, arguing that the latter firm was using the database, which reveals the names of domain owners, in order to make marketing pitches to Register.com customers. A preliminary injunction was granted against Verio in December of that year.

According to reports, the case will now return to New York's District Court. Register.com is seeking a permanent injunction, and undisclosed damages.

Welcoming the ruling, President and CEO of Register.com, Peter Forman, commented:

"The court's decision vindicates our position and shows that we will not tolerate attempts to co-opt our valuable brand and goodwill."
