Indian Court Issues Landmark Ruling On Spam

A court in New Delhi this week issued a landmark ruling on spam, according to reports in the regional media.

Ruling on Tuesday, Judge R.C. Chopra found in favour of Indian telecommunications firm, Tata Sons, and its subsidiary, Panatone Finwest, which own a large stake in the state-owned internet service provider (ISP), VSN Limited.

The case began following a complaint from Tata Sons, which alleged that by sending large amounts of unsolicited commercial e-mails, McCoy Infosystems Private had "trespassed" on VSNL's property, and had "severely degraded VSNL's capacity to function effectively".

The firm decided to rely on trespass of goods and nuisance laws because currently, Indian law does not address the problem of spam.

Welcoming the verdict, Tata Sons' attorney, Pravin Anand confirmed to the Press Trust of India that:

"This is the first court order in the country on spamming."
