According to the latest Big Question poll conducted by the Legal Week news service and EJ Legal, the issue of liability capping for lawyers is becoming less of a taboo than it once was.
It emerged that of the 100 senior lawyers questioned, 60% 'sometimes' agree liability limits for individual instructions, and a further 12% do so 'often', or 'all the time'.
The number of lawyers questioned who 'never' seek to cap liabilities for potential negligence claims was just 28%, down from 47% in a poll on the subject undertaken last year.
Speaking to Legal Week with regard to the survey results, an unnamed head of corporate at one of London's leading law firms observed that:
"It remains the exception rather than the rule, but as time goes on, there will be a greater focus by law firms on this area."
