H.R. 2929, also known as the Securely Protect Yourself Against Cyber Trespass or SPY Act has been passed by the House Subcommittee on Commerce, Trade and Consumer Protection, it has emerged.
The legislation, which calls for penalties of up to $3 million for infringements, requires that internet users be clearly informed prior to the downloading of spyware software, which tracks and transmits information on their internet use and other personal information.
In addition, the Act includes prohibitions on the use of technologies such as key-stroke logging, the hijacking of computers, and the creation of adverts which cannot be closed.
Speaking regarding the passage of the bill, chairman of the Commerce, Trade and Consumer Protection subcommittee, Rep. Cliff Stearns (R-Fla) observed that:
"Spyware continues to spread and plague legitimate computer users. This rapid growth makes passing the legislation before us even more critical. This legislation will directly target the advancing spread of spyware and provide strong protections for all computer users' rights to privacy."
The bill must now go before the House Energy and Commerce Committee.
