Earlier this month at a meeting of the Asia Pacific Economic Cooperation forum's IP Rights Expert Group, Hong Kong's Intellectual Property Department sought the assistance of its counterparts.
According to reports, a representative from the IPD requested the advice of other IP authorities in the region on how to deal with the registration by counterfeiters of company names which incorporate the trade mark of a legitimate business.
Under Hong Kong's current company registration rules, the issue of whether a proposed company name is confusingly similar to other registered business names is not taken into account prior to incorporation. Opposition to a rival firm's choice of name is also not permitted until it has been registered.
Hong Kong's proximity to and close relationship with the Chinese mainland has additionally been cited as a key reason why such fraudulent registrations are more prevalent in the territory than elsewhere in the region.
