Ruling on Wednesday in Massachusetts District Court, Judge Douglas Woodlock found in favor of online search portal Google, arguing that its Google Earth software does not infringe a patent held by Skyline Software Systems.
Skyline first launched a patent infringement action against the provider of the software, Keyhole Inc. in 2004, arguing that Keyhole had infringed patent no. 6,496,189. Google acquired Keyhole later that year.
Delivering his summary judgement, Judge Woodlock argued that Google Earth differed significantly from Skyline's own software, in that it merely attempts to show users an aerial view of the areas covered, and does not attempt to show features of the terrain, as Skyline's mapping technology does.
According to reports, he declined to accept motions on the validity of the disputed patent, but left the matter open for a reassertion of the claims, if such action is taken before April 20.
