Computer manufacturer, Gateway Inc. has filed suit against larger rival, Hewlett Packard alleging that HP has violated five of its patents related to the multimedia functions of desktop and laptop computers.
The lawsuit, filed in San Diego on Monday, represents a response to patent violation charges levelled at Gateway by Hewlett Packard six weeks ago.
HP also recently filed a complaint with the International Trade Commission, accusing Gateway of infringing seven of its patents.
Speaking to the LA Times with regard to the countersuit, Gateway spokesman, Ted Ladd explained that:
"We are disappointed that HP has chosen to travel this road, and feel we have no choice but to respond in kind."
He continued:
"We're really going step for step with them in this dispute. We actually believe that HP has much more at risk than Gateway in this lawsuit, particularly because of the scale and scope of their products."
Gateway is seeking unspecified damages, and has requested that all charges levelled against it by its larger rival be dismissed.
