California-based internet service provider (ISP), Hypertouch on Friday filed a complaint with the US District Court for the Northern District of California, alleging that home improvements site, BobVila.com has violated the recently enacted CAN SPAM Act.
According to the ISP, the defendants sent Hypertouch and its customers spam e-mail in the form of advertisements with fraudulent headers. It further alleged that the unsolicited mails contained no physical address for the company (a requirement under the new legislation), and that they were sent to randomly generated and harvested addresses, in addition to addresses gathered from the 'opt out' lists created by other spam.
Explaining to Internetnews.com the reasoning behind the company's decision to take action, Hypertouch President, Joe Wagner observed that:
"The Can Spam Act provides only the most minimal protections to the public. But BobVila.com and BlueStream Media failed to observe even those."
He went on to add:
"I cannot understand why any legitimate business would run the tremendous legal and public relations risk in harassing millions of people with spam."
The suit calls upon BobVila.com to stop sending unsolicited e-mails, and asks that the home improvements site be required to pay damages and legal costs.
