It emerged last week that UK-based technology, media and telecommunications specialist, Bird & Bird has become the first foreign law firm to benefit from the Closer Economic Partnership Agreement (CEPA) between Hong Kong and mainland China.
Under the CEPA, which came into force on January 1, Hong Kong law firms are permitted to operate on the mainland, and to seek alliances with their Chinese counterparts. Bird & Bird has been granted permission by the Chinese Ministry of Justice to launch an operation in Beijing via its Hong Kong branch, rather than the UK parent firm.
Speaking to the Legal Week news service, an unnamed China-based partner observed that:
"This shows that the Ministry of Justice is more broad-minded to international firms. It is honouring the CEPA agreement even though Bird & Bird does not fit the category of a Hong Kong law firm."
