According to a report in the Gibraltar Chronicle, the European Commission will today consider the legislation formulated by the UK government enabling residents of Gibraltar to vote in elections to the European Parliament.
The main issue is expected to be whether voting rights extend not only to Gibraltarians but to residents of the Rock who originate from 'third' countries, namely British colonies and dependent territories.
It has been reported that the Spanish government in particular is leading the way in questioning this aspect of the British legislation which appears to suggest that this will be the case, and Spain is arguing that such an eventuality would have profound implications for the definition of European Union citizenship.
In addition, the Chronicle reports that Spain will question the decision to incorporate Gibraltar as part of the United Kingdom South West constituency for the purposes of European elections.
