E-Data Launches New Patent Infringement Suits

Technology firm, E-Data Corporation announced on Tuesday that it is suing digital stock photography providers, Getty Images and Corbis over their use of technology which allows users to browse, license, and download images via the internet.

E-Data claims that it owns a patent relating to the downloading of media from a computer to another device, such as a CD, DVD, or MP3 player, and to the downloading of photographs and news content.

Although patent No. 4,528,643 expired in the United States in 2003, meaning that the firm can no longer claim damages, it can sue over infringements of the technology which have taken place over the last six years. In addition, the patent still has nearly a year before it expires in Europe.

Speaking to Internetnews.com, a Getty Images spokesman refuted the claims, announcing that:

"We don't believe anything we do infringes on their patent, and we intend to vigorously defend our position."

E-Data recently reached a settlement with UK-based OnDemand Distribution (OD2), Microsoft, and Tiscali over pay per song download services offered by the three firms, which it claimed infringed its patent. Discussions with Apple Computer over the latter's iTunes Music Store are also said to be underway.
