According to reports in the US media, pop-up advertisement provider, Claria Corporation (formerly Gator) has recently settled several lawsuits brought against it by aggrieved website owners.
The firm, in common with rival firm WhenU.com, delivers its advertising software to users when they download other software, with the result that they are often unaware that it has been installed on their computer.
The software then examines keywords, search terms and URLs, and delivers advertisements based on its findings. However, many of the providers advertising with the service are in direct competition to the owners of the websites being viewed, which has led to the recently settled legal actions.
CNet News reported recently that the recent settlements of actions brought by Wells Fargo, Quicken Loans, UPS, Hertz, LL Bean, Tiger Direct and Six Continents, has cast a question over the legality of the advertising software which may only be resolved when similar actions against WhenU reach the courts.
