Canadian Intellectual Property Office To Consult On Patent Rule Changes

by Mike Godfrey, Tax-News.com, Washington

01 December 2008

The Canadian Intellectual Property Office (CIPO) announced late last week that it had launched a consultation on several proposed amendments to various aspects of the country's patent rules.

CIPO revealed that the consultation will be broken down into four separate packages. Stakeholders will be provided with between 30 to 60 days to provide comments on each package, with the first consultation period beginning on November 27, 2008, and ending January 5, 2009.

It explained that:

"The amendments proposed in the first package are generally housekeeping in nature and deal with minor legalities and procedural issues as opposed to questions of substantive policy."

Those proposed changes include:

  • The definition of "description";
  • Establishment of the Filing Date;
  • Form 3; and
  • Completion requirements (Declaration of Entitlement or Assignments).
